Payment of shift penalties


As you may be aware, the Australian Services Union (ASU) and Mercy Connect have been in discussions regarding the payment of the shift penalties for employees who work immediately before and after sleepovers.

If you currently work those shifts, you will already receive payment of the shift penalty for the entirety of that shift. However, between 1 January 2012 and 31 December 2013, shift penalties were not paid on shifts immediately following a sleepover.

As a result of the negotiations between the ASU and Mercy Connect, we are pleased to announce that Mercy Connect is prepared to make payment to eligible employees for any unpaid shift penalities during that time.

You will be eligible for this payment if you:

  • Worked shifts between 1 January 2012 and 31 December 2013;
  • Those shifts include a sleepover; and
  • You were rostered to work both immediately before and immediately after the sleepover in the same shift.

If you believe you satisfy the above criteria, please let Mercy Connect know as soon as possible by filling out the attached form (Pay Claim Form_June 2019) and including as many details as possible as to when you worked, what shift patterns you worked, and any copies of timesheets, rosters or payslips you may have. Once you have complete this, please email this directly to Ms. Jessie Arney at [email protected]. Please note that claims with insufficent detail on the form or are not accompanied by supporting documentation may not be processed by the Payroll team.
